1. Agreement

By downloading, installing, or using CaptionSnap ("the App"), you agree to these terms and the Privacy Policy. Together, these documents constitute the entire agreement between you and CaptionSnap regarding your use of the App. If you do not agree, do not use the App.

2. Eligibility

You must be at least 14 years old (the age threshold under Austrian law) to use CaptionSnap. By using the App, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent's or legal guardian's consent.

CaptionSnap grants you a personal, non-exclusive, non-transferable license to use the App on up to 3 devices that you own or control, subject to these terms.

4. Trial and Purchase

CaptionSnap offers a 14-day free trial with full functionality. After the trial period, a one-time purchase is required to continue using capture features. Existing transcripts, notes, and summaries remain accessible after the trial expires.

Purchases are processed by LemonSqueezy (Lemon Squeezy LLC) as merchant of record. Your payment information is handled entirely by LemonSqueezy and is never seen or stored by CaptionSnap. LemonSqueezy's terms of service apply to payment transactions.

5. Right of Withdrawal (EU Consumers)

Under the EU Consumer Rights Directive (2011/83/EU), as implemented in Austria by the Fern- und Auswärtsgeschäfte-Gesetz (FAGG), you have a 14-day right of withdrawal for online purchases of digital content. The right of withdrawal expires once the digital content has been fully delivered, provided that (a) you gave express prior consent to begin delivery before the withdrawal period ended, (b) you acknowledged that you thereby lose your right of withdrawal, and (c) you received confirmation of this on a durable medium (such as the purchase confirmation email from LemonSqueezy).

This statutory provision does not affect the voluntary 30-day refund policy described below, which is more generous than the statutory minimum.

6. Refund Policy

CaptionSnap offers a 30-day no-questions-asked refund policy. If the App does not meet your needs, contact [email protected] within 30 days of purchase for a full refund.

7. What CaptionSnap Does

CaptionSnap reads live caption text from supported meeting applications (Microsoft Teams, Zoom, Google Meet) and saves it as local transcript files. It uses the macOS Accessibility API, the same system interface used by screen readers and other assistive technologies, to read text that meeting applications have already rendered in their user interface. CaptionSnap does not access audio streams, network traffic, or communications in transit. All processing occurs locally on your device.

Unlike meeting bots or AI notetakers that join meetings as participants and transmit audio to external servers, CaptionSnap operates entirely on your device. It does not join, connect to, or interact with any meeting service. No meeting content is transmitted to CaptionSnap, its developer, or any third party.

CaptionSnap requires macOS Accessibility permission to read caption text from meeting applications. This permission is granted through macOS System Settings and can be revoked at any time. CaptionSnap uses this permission solely to read caption text and does not use it to control, modify, or interact with other applications.

Laws regarding consent for recording, transcribing, or otherwise capturing conversations vary significantly by jurisdiction. In some US states, including California, Illinois, Florida, Pennsylvania, Washington, and others, all parties to a confidential or private conversation must consent before it can be recorded or transcribed by any means. Although CaptionSnap reads text already displayed on your screen rather than recording audio, some jurisdictions define "recording" or "eavesdropping" broadly enough that saving captions may be subject to their consent requirements. Workplace monitoring regulations may impose additional requirements in the EU. It is your sole responsibility to understand and comply with the laws that apply to your specific situation, including obtaining all-party consent where required.

As a matter of professional courtesy and best practice, CaptionSnap recommends that you inform meeting participants when you are capturing captions. This recommendation is not a legal determination that consent is required in your jurisdiction.

CaptionSnap is a tool that captures text already displayed on your screen. Whether and how you may use that text is governed by your local laws, workplace policies, and the terms of your meeting platform. CaptionSnap does not provide legal advice.

11. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the operator of CaptionSnap (see Impressum) from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your fault or negligence in connection with:

This section does not apply to consumers within the meaning of the Austrian Konsumentenschutzgesetz (KSchG) to the extent prohibited by mandatory consumer protection law.

12. Disclaimer of Warranties

Mandatory consumer rights: If you are a consumer in the EU/EEA, you have statutory warranty rights (Gewährleistung) under the Verbrauchergewährleistungsgesetz (VGG) and related legislation, including a mandatory warranty period for digital content. These rights are not affected or limited by any provision in these terms.

SUBJECT TO THE MANDATORY CONSUMER RIGHTS STATED ABOVE, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ADDITIONAL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CAPTIONSNAP DISCLAIMS ALL NON-MANDATORY WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing:

Nothing in these terms excludes or limits liability that cannot be excluded under applicable law, including liability for fraud or willful misconduct.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPTIONSNAP AND ITS DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, REGARDLESS OF THE THEORY OF LIABILITY.

Total aggregate liability for all claims is limited to the amount you paid for the App.

This limitation does not apply to liability that cannot be excluded under mandatory provisions of Austrian or EU law.

14. Intellectual Property

CaptionSnap, including its code, design, and documentation, is the intellectual property of its operator (see Impressum). All rights not expressly granted in these terms are reserved.

Transcript files generated by the App are yours. CaptionSnap claims no ownership or rights over content you create with the App.

15. Third-Party Trademarks

Microsoft Teams, Zoom, and Google Meet are trademarks of their respective owners (Microsoft Corporation, Zoom Video Communications Inc., and Google LLC). CaptionSnap is an independent product and is not affiliated with, endorsed by, or sponsored by Microsoft, Zoom Video Communications, or Google.

16. Updates

CaptionSnap may check for and offer software updates. Updates may be necessary to maintain compatibility with meeting applications or macOS. Installing updates is optional.

17. Termination

You may stop using CaptionSnap at any time by uninstalling the App. Your license terminates automatically if you materially breach these terms. Upon termination, your transcript files remain on your device.

18. Changes to These Terms

These terms may be updated. Material changes will be communicated through the App's update notes and posted here with a new "Last updated" date. For material changes, you will be notified and asked to accept the updated terms before they take effect. If you do not agree with updated terms, you may stop using the App. Non-material changes (corrections, clarifications) take effect upon posting.

19. Severability

If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid, or if modification is not possible, severed. The remaining provisions continue in full force and effect.

20. Waiver

Failure to enforce any provision of these terms does not constitute a waiver of the right to enforce it in the future.

21. Assignment

You may not assign or transfer your rights or obligations under these terms without prior written consent. CaptionSnap may assign its rights and obligations in the event of a business transfer, restructuring, or sale of substantially all assets.

22. Force Majeure

Neither party is liable for delays or failures in performance caused by events beyond reasonable control, including but not limited to natural disasters, government actions, internet outages, or changes to third-party meeting applications.

23. No Third-Party Beneficiaries

These terms do not create any third-party beneficiary rights. No person other than you and the operator of CaptionSnap has the right to enforce any provision of these terms.

24. Governing Law and Jurisdiction

These terms are governed by the laws of Austria, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Vienna, Austria.

If you are a consumer habitually resident in the EU/EEA, you also benefit from the mandatory consumer protection laws of your country of residence, and you may bring proceedings in the courts of your country of residence. Nothing in these terms affects your statutory rights as a consumer under EU law.
